Camera Surveillance for the Purpose of Investigating Criminal Offenses

The police is allowed to use cameras for the purpose of investigating criminal offenses and prosecuting individuals suspected of criminal offenses that have been recorded. The police will then use cameras to observe one or more specific suspects or suspicious premises.

The use of cameras as an investigative tool is connected with special powers laid down in the Code of Criminal Procedure. The police may only use these powers with the permission of the prosecutor (under Article 177q and r of the BES Code of Criminal Procedure).

In other situations, the police is not allowed to systematically observe an individual, whether or not by means of a camera.
